Prop 49 is the result of the duly enacted SB 1272. The CA Supreme Court's action denies the People of California their 1st Amendment right to "petition the government for redress of grievances" and violates the peoples' 14th Amendment protection against the enforcement of any law "which shall abridge the privileges... of citizens of the United States."
The Chief Justice, in dissent, notes that nothing in the Howard Jarvis Taxpayers Association's suit warrants the Court taking "the extraordinary step of removing the measure from the ballot, thus disenfranchising the voters."
The only appropriate course for the California Supreme Court is to return Proposition 49 to the ballot.
